The primary purpose of this Bill is to close an existing loophole in the law. Under the Offences Against the State (Amendment) Act 1998 it is an offence to withhold information in respect of a serious criminal offence. However, that provision of the 1998 Act specifically excludes sexual offences. The Residential Institutions Statutory Fund Bill provides for the establishment of a Statutory Fund to support the needs of survivors of residential institutional child abuse. 15,000 former residents are expected to be eligible to apply for support from the Fund and every effort is being made to minimise the administration involved. Some former residents advocate a simple distribution of the available money.
